Terms of Service Agreement

 

By ordering services from Nick Cody Photo, the Client agrees to the following Service Agreement for photography, video, and other related services. 

 

To schedule an appointment, a $50 booking fee is required at the time at booking which will be credited towards the final bill. The booking fee is non-refundable and helps cover the expense of same day cancelations.

Scheduling: 

 

Please confirm the property is ready prior to the scheduled appointment. 

 

By scheduling an appointment, you agree that the home will be ready for photographs or video at the scheduled date and time you have selected. It is your responsibility to work with the builder or seller to ensure the property is ready at the scheduled time. 

 

If not ready at the scheduled appointment time, the property will not be photographed or filmed, and will result in the forfeiture of the $50 booking fee for that date. 

 

Due to liability concerns, Nick Cody Photo does not handle any of the preparation for property readiness, including but not limited to, cleaning and moving furniture. 

 

Photographs are delivered the next day.   

 

Turnaround time for video is typically 2-5 business days. 

 

Limited Licensing:

Photographs, video, and other media created by Nick Cody Photo are  licensed specifically for limited use. 

 

Images and video delivered are licensed for:

• The purpose of listing a property 

• For the duration of the listing

 

Images and work purchased by the Client are available for posting on multiple listing services, promoting the listing on social media sites, and other forms of electronic and print advertisement for the purpose of promoting the property listing. 

 

Only the Client has sole permission to use purchased images and work to advertise and promote the property. Third parties are not permitted to use images or work created by Nick Cody Photo. Photographs and video can be made available to another real estate agent who takes over an expired listing for a $100 rebranding fee. 

 

In order to provide consistent high-quality work, delivered images are not to be altered or edited further in any way other than resizing or slight cropping.

Cinematic videos will typically showcase the exterior of the property followed by the interior. Videos will use royalty free music. Please make note if a different format is needed.

All photographs, video, and media are copyright of Nick Cody Photo. 

 

Nick Cody Photo reserves the right to reproduce and use photographs, video, and or media for advertising, physical and digital display, publication, and other purposes deemed appropriate by Nick Cody Photo. Nick Cody Photo agrees to not use photos, video, or media in a way that would interfere with the licensing agreement set with the Client.

Payment Policy:

​

A non-refundable booking fee of $50 is charged at the time of booking to hold your scheduled appointment time. The booking fee is credited towards your amount due unless cancelling or rescheduling an appointment with less than 24 hours notice. 

 

The remaining total balance is due at the time you wish to download the images or video.

 

You will have the opportunity to review the images and/or video before completing the payment. 

 

Any additional editing of photography or video requested after the final product has been delivered, will be subject to a re-editing fee of $35.  

 

Cancelation and Refund Policy:

Bookings may be rescheduled for no additional cost with at least a 24 hour notice before the scheduled appointment. 

 

Canceling or rescheduling an appointment with less than 24 hours from the scheduled time will result in the forfeiture of the $50 booking fee. 

 

Rescheduling will be subject to the availability of the photographer. 

 

Weather Policy:

​

No additional fee will be charged for rescheduling due to inclement weather, but you must inform Nick Cody Photo prior to the appointment time, if you plan to reschedule due to weather. 

 

Understand that some services such as drone/aerial photography and video may not be available in the event of rain or high winds.

 

Severability:

​

If one or more of the provisions within the Terms of Agreement is found to be invalid or unenforceable, the validity of the remaining provisions will not be affected. Provisions will be revised only to the extent to make them valid and enforceable.
